These Terms of Service ("Terms") govern your use of the Firebrand Event Productions website (firebrandep.com) and related staffing communications, including SMS messages sent to freelancers and other workers who opt in. By using our website or opting in to staffing SMS, you agree to these Terms.

Who We Are

Firebrand Event Productions provides event production, logistics, and freelance staffing services. These Terms apply to website visitors and to individuals who receive or send staffing-related text messages with us.

Website Use

You may use our website for lawful purposes only. You agree not to misuse the site, attempt unauthorized access, interfere with its operation, or submit false or misleading information through forms or other channels.

Staffing and SMS Communications

If you opt in to SMS / text messaging for staffing, you agree that Firebrand may send you text messages about shifts, opportunities, scheduling, reminders, and related operational updates. Message frequency varies. Message and data rates may apply.

To stop messages, text STOP. For help, text HELP or contact info@firebrandep.com or (305) 874-0000. Opting in to SMS is voluntary and is not required to apply for or accept work, except that SMS may be how we deliver staffing updates once you choose that channel.

Receiving or responding to a staffing text does not by itself create an employment relationship. Any engagement for paid work is governed by the separate agreement, offer, or terms applicable to that assignment.

Privacy

Our collection and use of personal information is described in our Privacy Policy. By using our services, you also acknowledge that policy.

Intellectual Property

Site content, branding, and materials owned by Firebrand remain our property. You may not copy, redistribute, or use them for commercial purposes without our prior written permission.

Disclaimers

The website and SMS tools are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Firebrand disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. Limitation of Liability

To the fullest extent permitted by law, Firebrand Event Productions and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or SMS communications. Our total liability for any claim related to the website or SMS program is limited to the greater of (a) the fees you paid us for the specific service giving rise to the claim in the twelve months before the claim, or (b) one hundred U.S. dollars ($100), except where liability cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold harmless Firebrand from claims arising out of your misuse of the website, your violation of these Terms, or your unlawful use of staffing communications, except to the extent caused by our willful misconduct.

We may update these Terms from time to time. The effective date above will change when we do. Continued use of the website or continued opt-in to SMS after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts located in Miami-Dade County, Florida, have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law.
